These Terms control your access and interactions with Endocanna’s websites, content, products (including reports), and services that have been made available by Endocanna. By using and receiving the benefit of Endocanna’s services, you agree to be bound by these Terms, creating a contractual relationship between yourself and Endocanna. The Terms constitute the entire agreement between you and Endocanna and govern your use of Endocanna’s services, superseding any prior agreements between you and Endocanna on this subject. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software. Endocanna has the right to modify these Terms or any additional terms that apply to Endocanna’s services at any time, including to reflect changes to the law or changes to Endocanna’s services. We will notify you of any material changes by posting information through Endocanna’s services or via email. Any continued use of Endocanna’s services after a change to the Terms will mean you accept the changes. If any changes are unacceptable to you, you may stop using Endocanna’s services and, if applicable, close your account.

Endocanna is Not a Medical Services Provider

Endocanna does not provide medical services. Endocanna’s reports are not to be considered or construed to be medical advice. The information contained in Endocanna’s reports is not intended to be substituted for the advice or consultation of a medical professional. Endocanna’s reports include cannabinoid compound suggestions based on your DNA and do not constitute medical advice, diagnosis, or consultation. Endocanna does not take responsibility for any side effects or medical issues that may arise from your use or consumption of the suggested cannabinoid compounds. Endocanna recommends consulting with a medical professional before use of any suggested cannabinoid compounds. License

Endocanna’s reports contain photos, records, and content that are owned by or are licensed to Endocanna. Endocanna grants you a non-exclusive, fully revocable, non-transferrable license to this content only as necessary for your personal use of Endocanna’s reports. You may not use this content for any other purposes without the prior written consent of Endocanna.

Third Party Services and Content

Advertising from our business partners may be allowed to provide you with special offers, including personalized cannabinoid compound suggestions and details on where to purchase the compounds. Endocanna exercises caution when selecting its business partners and will make a good-faith effort to ensure its business partners meet Endocanna’s high standards.

Ownership

Endocanna’s services and all rights therein are the sole and exclusive property of Endocanna. Neither these Terms nor your use of Endocanna’s services grant to you any rights in Endocanna’s physical or intellectual property. Any rights not expressly granted in these Terms are hereby expressly reserved.

User Accounts

In order to use Endocanna’s services, including this report, you must have an account with Endocanna and must agree to Endocanna Health Inc.’s Terms of Service, which are incorporated by reference herein and accessible at www.Endocannahealth.com.

User Requirements and Conduct

By receiving an Endocanna report, you expressly agree to only use the information contained within the report for authorized and legitimate purposes. You also agree to comply with all applicable state laws when using Endocanna’s services. Endocanna is not liable for any nuisance, annoyance, inconvenience, or property damage you may cause to a third party as a result of the information received from an Endocanna report.

User Provided Content

For any content you share or upload through any of Endocanna’s services, you grant Endocanna a sub-licensable, worldwide, royalty-free license to host, store, copy, publish, distribute, provide access to, create derivative works of, and otherwise use such content to the extent and in the form or context we deem appropriate on or through any media or medium and with any technology or devices now known or hereafter developed or discovered.

Indemnity

You expressly agree to defend and hold Endocanna, and its subsidiaries, affiliates, officers, agents, contractors, partners, employees, successors, and assigns harmless from any claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any content you submit, post to, or transmit through Endocanna’s services; your use of Endocanna’s services; your connection to Endocanna’s services; your violation of these Terms or Endocanna’s Terms of Service; or your violation of any rights of another.

Choice of Law

The laws of the State of California and as applicable, those of the United States of America, govern these Terms and the use of Endocanna’s services. All claims brought in the United States will be subject to the jurisdiction of the courts of the State of California.

Severability

If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.

No Waiver

Any failure of Endocanna to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

Copyright and Trademark Notice

Each of Endocanna’s services is protected by copyright as a collective work pursuant to U.S. copyright laws, international conventions, and other copyright laws. The trademarks, service marks and logos contained in Endocanna’s services are owned by or licensed to us. We and our licensors retain title, ownership and all other rights and interests in and to all content used in conjunction with Endocanna’s services.

Notice

Endocanna may contact you within Endocanna’s services, via email or physical mail to inform you of changes to Endocanna’s services or these Terms. You agree that contact in any of these ways will satisfy any legal communication requirements, including that communication be in writing.

Disclaimer

Endocanna’s reports are based on its proprietary algorithm and researched SNP panels. Some users may have extreme tolerances (both high and low) with respect to cannabinoids, including THC and CBD. Endocanna’s reports for these users might not be as accurate for individuals with average tolerance levels. Endocanna makes no guarantee regarding the efficacy of the suggested cannabinoid compounds. The suggested cannabinoid compounds have not been approved by the US Food and Drug Administration (FDA) and the FDA has determined that such clearance or approval is not necessary. Endocanna makes no representations, guarantees, or warrantees with respect to any of Endocanna’s services, including the reliability, timeliness, suitability, quality, or availability of Endocanna’s reports. Endocanna makes no representations, guarantees, or warrantees with respect to any third party providers or manufacturers.
